Terms of Service

These Terms govern access to and use of VisitOMS (“Service”). By accessing or using the Service, you agree to these Terms. If you use VisitOMS on behalf of an organization, you represent that you have authority to bind that organization.

1) Accounts & access

You are responsible for maintaining the confidentiality of your login links/sessions and for all activity under your account. Organizations (agency admins) manage access and permissions for their users.

2) Acceptable use

You agree not to misuse the Service. For example, you will not:

  • Attempt to gain unauthorized access to systems, accounts, or data.
  • Upload malicious code or interfere with the Service’s operation.
  • Use the Service to violate applicable laws or third-party rights.
  • Reverse engineer the Service except to the extent permitted by law.

3) Customer data

“Customer Data” means data submitted to the Service by or on behalf of an organization, including scheduling, progress tracking, notes, and uploaded documents. Organizations control Customer Data.

You grant VisitOMS permission to process Customer Data solely to provide and improve the Service, and as otherwise described in the Privacy Policy and applicable agreements.

4) Billing & subscriptions

Paid plans, billing cycles, fees, and invoice terms are described in your subscription and/or order documents. Taxes may apply. Non-payment may result in suspension or loss of access after reasonable notice.

5) Availability & changes

We strive for high availability, but the Service may occasionally be unavailable due to maintenance or factors outside our control. We may update or modify features over time.

6) Intellectual property

VisitOMS and its software, designs, and content are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works of the Service.

7) Disclaimer

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

8) Limitation of liability

To the maximum extent permitted by law, VisitOMS will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill. Our total liability for any claim will not exceed the amounts paid for the Service in the period specified in your agreement (or, if none, a reasonable limit).

9) Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, fail to pay fees, or use the Service in a way that creates risk or legal exposure.
